Boda Boda Rider Who Killed His Cheating Wife’s Lover After He Found Them In Bed Finally Set Free By Court, Judge Reveals Why

The High Court ruled in favour of a boda boda rider who had been accused of killing another identified as EMO. According to Justice Roselyn Aburili’s ruling, the murder suspect was coerced into carrying out the crime.

The dead, identified as COO, was found in bed with his wife in December 2022.The suspect, who had warned the victim multiple times, killed him. The Kisumu High Court later discharged the suspect on the grounds that the murder was committed without premeditation or malice.

The boda boda rider, who was identified as COO in court, killed EMO after discovering her in bed with COO’s wife. The COO discovered that his wife was disappeared after visiting a hospital to check on his ailing child.

Over the phone, the lady informed COO that she had gone back home to take care of their other child. COO raced home after spending hours in the hospital, where he gave his wife an EMO in bed.The court heard that he attacked him. After taking into account the testimony of all eight witnesses, Justice Roselyn Aburili concluded in her decision that the dead pushed COO to the brink.

This came about when the court was informed that the deceased man had been seen multiple times with the suspect’s wife. He has received multiple warnings.In her ruling, after considering the accounts of all eight witnesses in court, Justice Roselyn Aburili argued that the deceased pushed COO to the edge.

This was after the court heard that the man (deceased) had severally been caught with the suspect’s wife. He had been warned on numerous occasions.

“I am satisfied that the accused person unlawfully killed the deceased in the heat of passion, having found him having sex with his wife who had abandoned a sick child in hospital. I find and hold that malice aforethought was not proven beyond a reasonable doubt, despite the serious multiple injuries inflicted on the deceased using a panga,” Daily Nation quoted Aburili as saying.

The court determined that COO lost self-control when he punched both his deceased wife and herself, even though it resulted in death.After being found guilty of manslaughter and given an 18-month sentence, he was released from custody after spending several months in detention following his police surrender in December 2022.

This occurred months after one of Kenya’s most well-known murder trials resulted in a death sentence.
